§ A263-1. Fees established.
The following fees are hereby established: | A. | Chapter 91, Alcoholic Beverages. [Amended 4-8-1999 by Ord. No. 4-99; 8-14-2003 by Ord. No. 06-03] | (1) | Article I, Licensed Premises. Fees for retail licenses to sell alcoholic beverages shall be as follows: | (a) | Plenary retail consumption license: $1,000. | | (b) | Plenary distribution license: $1,000. | | (c) | Club license: $120. | | | | B. | Chapter 95, Amusement Devices. [Amended 8-14-2003 by Ord. No. 06-03] | (1) | License fee: $35 per machine to be licensed. | | | C. | Chapter 115, Uniform Construction Codes. [Amended 2-7-1992 by Ord. No. 6-92; 9-14-1995 by Ord. No. 11-95; 12-7-1995 by Ord. No. 13-95; 6-12-1997 by Ord. No. 5-97; 9-10-1998 by Ord. No. 11-98; 10-14-1999 by Ord. No. 12-99] | (1) | The fee for a construction permit shall be the sum of the subcode fees listed, plus all applicable special fees such as elevator or sign fees. | (a) | The building subcode fees shall be: | [1] | The new construction fee shall be as follows: | [a] | Use Groups B, H, I-1, I-2, I-3, M, E, R-1, R-2, R-3, R-4 and U: volume of Building (cubic feet) times $0.030 = volume fee. | | [b] | Use Groups A-1, A-2, A-3, A-4, F-1, F-2, S-1 and S-2: volume of building (cubic feet) times $0.027 = volume fee. | | [c] | Commercial farm building: volume of building (cubic feet) times $0.010 = volume fee. | | | [2] | For renovations, alterations, repair and minor work fees. | [a] | Estimated cost up to $50,000: $18 per $1,000. | | [b] | Portion of cost over $50,001: $9 per $1,000. | | [c] | For combination of work involving new structures and existing structure work, the sum of the fees are computed separately as renovations/alterations/repairs and volume fees. | | [d] | Installation or replacement of storage tanks up to 550 gallons for R-3/R-4: $50. | | [e] | Installation of underground storage tank: $85 per tank. | | [f] | Taking tank out of service, altering the piping or otherwise modifying any installation: $18 per $1,000 of estimated cost of removal. | | | [3] | Minimum fee shall be $50. | | | (b) | The plumbing subcode fees shall be as follows: | [1] | Total number of fixtures: $10 per fixture. (NOTE: Fixtures to include all fixtures, pieces of equipment or appliances connected to the gas piping or oil piping system, except as indicated below.) | | [2] | Total number of special devices: $65 per device. (Double-faced signs fee will be based on one side of face.) | | (c) | Certificate of occupancy fees. | [1] | Fee shall be set in the amount of 10% of permit fees for new structures, with minimum of $35 and maximum of $200. | | [2] | The fee for a certificate of occupancy granted pursuant to a change of use group shall be $220. | | [3] | The fee for a certificate of continued occupancy issued for all uses except R-3 under N.J.A.C. 5:23-2.23c shall be $200. | | | (d) | Variation. The fee for an application for a variation in accordance with N.J.A.C. 5:23-2.10 shall be $594 for Class I structures, $120 for Class II structures, and $65 for Class III structures. | | (e) | Lead hazard abatement. | [1] | The fee for lead abatement shall be $140. | | [2] | The fee for lead abatement clearance certificate shall be $28. | | | (f) | Swimming pool fees. | [1] | Building permit for an aboveground pool: $50. | | [2] | Building permit for an in-ground pool: $18 per $1,000 of the estimated cost of the work, provided that the minimum fee shall be $85. | | | (g) | Asbestos abatement: fee shall be $70 plus certificate of occupancy fee of $14. | | (h) | Standpipe fee shall be $229 for each standpipe. | | (i) | Miscellaneous fees. | [1] | For cross connections, backflow preventors, public swimming pools, spas and hot tubs that are subject to testing and require annual inspections, the fee shall be $45. | | [2] | In the case of discontinuance of work, all completed work will be computed. Any excess work will be refunded except 25% of excess for cost of permit fees and refunding. | | [3] | All suspensions of permits pursuant to N.J.A.C. 5:23-2.16[b] will not be refundable in whole or in part. | | [4] | The replacement of residential one- and two-family dwelling mechanical equipment shall be a total of $50 for all subcodes combined. | | | (j) | State training fees. Fees shall be pursuant to current regulations of N.J.A.C. 5:23-4.19. | | (k) | Engineering fees. | [1] | For engineering review: $200. | | | (l) | Special off-hours inspection fees. Fees to be determined by the Construction Official prior to any inspection and to be determined based on request. | | | | D. | Chapter 121, Dogs, Cats and Other Animals. | (1) | Fee for license, registration tag or registration sleeve: | (a) | Neutered animals: $8.20 for each dog or cat license. | | (b) | Unneutered animals: $11.20 for each dog or cat license. | | | (2) | Registration tag fee for dogs or cats which have a valid New Jersey license tag or sleeve: $1. | | (3) | Replacement fee for lost registration tag or sleeve: $1. | | (4) | License for kennel providing accommodation for 10 or fewer dogs and/or cats: $10. | | (5) | License for kennel providing accommodation for more than 10 dogs or cats: $25. | | (6) | Annual license fee for cattery or pet shop: $10. No. 20-05] | | (7) | Impoundment fees: | (a) | Initial fee: $25. | | (b) | Boarding fee: $4 per day. | | | | E. | Chapter 139, Fire Prevention and Protection. | (1) | No-smoking and other fire prevention signs: a fee equal to the cost thereof, but not to exceed $20 per sign. | | (2) | Non-life hazard uses: [Amended 5-12-2005 by Ord. If the application is received four to 10 business days prior to closing, the fee is increased to $70; if received fewer than four business days prior to closing, the fee increases to $125. Penalties for acts or omissions in violation of Chapter 139 shall be in accordance with the penalty provisions of the Uniform Fire Code, N.J.A.C. 5:70 2.12 and N.J.A.C. 5:70 2.12A. The penalty for failure to file a registration or pay when due an annual registration fee for a non-life hazard use shall be the same as is specified for life hazard uses. [Added 5-12-2005 by Ord. No. 6-00] | (1) | The fees imposed beginning January 1, 2001, shall be as follows: | (a) | Sports cards. | [1] | Residents of the Borough of Rockaway: $50 per person. | | [2] | Nonresidents of the Borough of Rockaway: $60 per person. | | [3] | Fees shall not exceed $150 per immediate family (three people) of residents of the Borough of Rockaway. | | [4] | Any holder of a sports card shall be entitled to use beach facilities without being required to obtain a separate beach badge. | | | (b) | Beach badges. [Amended 3-9-2006 by Ord. No. 02-06] | [1] | Season passes: | [a] | Residents of the Borough of Rockaway: $50 per person. | | [b] | Senior residents of the Borough of Rockaway (age 55 and older): Free. | | [c] | Nonresidents of the Borough of Rockaway: $100 per person. | | [d] | Children age five and under accompanied by a badge holder: Free. | | | [2] | Daily passes: | [a] | Residents of the Borough of Rockaway: $5 per day, plus $2 refundable deposit. | | [b] | Senior residents of the Borough of Rockaway (age 55 and older): $1. | | [c] | Nonresidents of the Borough of Rockaway: $7 per day, plus $3 refundable deposit. | | [d] | Children age five and under accompanied by a badge holder: Free. | | | [3] | Season fees shall not exceed $250 per immediate family (five people) of residents of the Borough of Rockaway. | | | (c) | Summer playground program card. [Amended 5-9-2002 by Ord. No. 04-02] | [1] | Residents of the Borough of Rockaway: $50 per person per eight-week session and $25 per person for a four-week session. | | [2] | Nonresidents may not participate in this program. | | | (d) | Senior citizen residents of the Borough of Rockaway: parks and recreation fees shall be waived upon presentation of proper identification of residency. | | (e) | Fees for teams using Borough facilities for adult softball: The fee for a team utilizing Borough facilities for adult softball shall be an annual charge of $350 per team. Any person requesting a team permit must submit a roster of team members at the time the application is made, and teams will be permitted to add players to the original roster without the payment of additional fees, provided that the addition of such players is in accordance with league rules. | | | | G. | Chapter 187, Peddlers, Solicitors and Auctioneers. | (1) | Badge deposit: $5. | | (2) | License fees: | (a) | Weekly license: $50 per week. (For purposes of this fee, a week shall constitute six consecutive days, excluding Sundays.) | | (b) | Monthly license: $100 per month. | | (c) | Yearly license: $500 per year. | | (d) | With respect to a peddler or solicitor conducting its business door-to-door or a person distributing advertising materials: $10 per day for a daily license. | | | (3) | License for charitable organizations: badge deposit of $5. | | (4) | Auctioneer permit fee: $5 per day. | | | H. | Chapter 193, Poolrooms and Billiard Rooms. | (1) | Annual license fees: | (a) | For the first pool or billiard table located on the premises to be licensed: $25. | | (b) | For each additional pool or billiard table located on the premises to be licensed: $10. | | | | I. | Chapter 197, Property Maintenance. | (1) | Fee for issuance of certificate of continued occupancy: $50. | | (2) | Fee for issuance of temporary certificate of continued occupancy: $75. | | | J. | Chapter 213, Sewers. [Amended 4-10-2003 by Ord. No. 03-03] | (1) | The fee to obtain permission to make a four-inch sanitary sewer connection from the sewer main to the curb shall be $500. The applicant for such connection shall be fully responsible to make such connection subject to the following conditions: | (a) | The applicant shall notify the Public Works Department of the intended date and time when such connection is to be made so that the Public Works Department may inspect such connection and approve of same before any backfilling of any excavation shall commence. | | (b) | At the time the applicant receives the permit to make such connection, the applicant shall provide the Borough Clerk with evidence of the existence of public liability insurance insuring the applicant in an amount not less than $1,000,000 per occurrence. | | (c) | The applicant shall post an escrow with the Borough of Rockaway in an amount of $200 to be retained by the Borough to assure that any repairs to public facilities such as road pavement, curbs, sidewalks and utilities shall be maintained in accordance with the requirements of the Borough Engineer for one year following the completion of such improvements. | | (d) | One year after any improvements are made to pavement, curbing and/or sidewalks or other public utilities or improvements, the applicants shall make an application for the escrow to be released. The application shall be made to the Public Works Department and upon certification to the Borough Treasurer by the Director of Public Works that the improvements and restoration are in satisfactory condition, the escrow may be released. Should the applicant fail to properly maintain the improvements, the Borough shall give the applicant notice of such deficiency, and should the applicant fail to correct such deficiency(ies) within 45 days of such notice, the Borough may proceed to have the deficiency(ies) corrected utilizing the escrow posted with the Borough. | | | | K. | Chapter 227, Taxicabs. No. 06-03] | (1) | Annual trailer park license fee: $900 plus $15 per week, per trailer, payable on the last day of the month. | | (2) | Transfer of license: $65. | | | M. | Chapter 241, Vehicles and Traffic. | (1) | Applications for parking permits: | (a) | Any vehicle owned by a person not a resident of the Borough: $32 per annum, per passenger vehicle. | | (b) | Replacement fee for any mutilated permit or for transfer to another vehicle: $1. | | (c) | Any vehicle owned by a Borough resident: $10 per annum, per passenger vehicle. | | (d) | One-day permit: $0.50 per passenger vehicle. | | | (2) | Storage of vehicles in Rockaway Borough municipal storage area: $2 per day. | | (3) | Fee for the services of police officers for private traffic control or other private police officer services. Any person, company or corporation who shall require the services of a police officer for private traffic control or other private police officer services shall be required to pay an hourly charge for such services equal to the hourly amount earned by the senior sergeant in the Borough plus an administrative fee of 15% of the hourly charge, with a minimum charge for such services equal to (four) hours (plus the 15% administrative add-on charge). No. 02-06] | | | N. | Chapter 247, Water. | (1) | Article I, General Regulations. | (a) | Tapping fees for all taps to the municipal water system will be $1,000 per connection. Water main taps up to two inches will be made by the Borough. Water main taps over two inches will be the responsibility of the owner or the owner’s contractor. All such taps shall be subject to inspection by the Borough. All excavation and backfilling are the responsibility of the owner or the owner’s contractor. The owner will supply the Borough with proof of liability insurance insuring against property damage and personal injury, naming the Borough as an additional insured. [Amended 3-11-2004 by Ord. In order to facilitate long-term improvements to the system, a connection fee of $5 per gallon of usage as estimated in accordance with N.J.A.C. 7:10-12.6, will be assessed on all connections. No. 02-04] | | | (2) | Article II, Meters. | (a) | Charge for repairing a frozen meter (because of weather conditions): $75. | | (b) | Meter test requested by property owner: the greater of the actual cost of testing the meter or $50, but if meter is found to register more than 3% more water than actually passes through it, it will either be replaced or repaired and no fee will be charged. No. 21-06] | $35.00 per box | | | (2) | Municipal Court discovery. Pursuant to N.J.S.A. 39:4-131: [Amended 12-9-2004 by Ord. No. 14-04] | (a) | All requests for discovery in matters pending in the Borough of Rockaway Municipal Court shall be submitted through the Municipal Prosecutor. | [1] | The following fees shall be payable by the requestor to the Borough for the discovery provided: | [a] | For each of the first 10 pages photocopied: $0.75 per page. | | [b] | For each of the next 10 pages photocopied: $0.50 per page. | | [c] | For each of the pages photocopied thereafter: $0.25 per page. | | [d] | Actual postage for any discovery sent by mail. | | [e] | For the envelope for any discovery sent by mail: $0.25. | | [f] | Photographs will be photocopied at the rates established herein. If requests are made for duplicate photographs, the actual cost of making the photographs shall be charged. | | [g] | Duplication of videotapes constitutes an extraordinary duplication process and will be charged at the rate of $5 per videotape. | | [h] | On any item that cannot be photocopied on the Borough copy machine or not otherwise provided for in this schedule, the actual cost incurred in making the copy plus a service fee of $35, shall be charged. No. 21-06] | | | [2] | Where the discovery must be obtained from an entity other than the Borough of Rockaway, e.g., another police department, the actual costs paid to the other entity shall be paid by the requestor. | | | (b) | If copies of reports are requested other than in person, an additional fee of $5 for the first three pages and $1 per page thereafter shall be added to cover the administrative costs of the report. | | | (3) | Breathalyzer ampoules. A fee of $7.50 shall be charged for furnishing breathalyzer tests ampoules, which require specialized handling and packaging because the ampoules contain concentrated acid. | | (4) | Tapes of Borough proceedings. A fee of $10 or the cost to duplicate the tape, whichever is greater, shall be charged for each tape recording of the Borough proceedings. | | (5) | Records not subject to examination or copying. Notwithstanding the provisions of this chapter, where it shall appear that the record or records which are sought to be examined and of which copies are requested shall pertain to an investigation in progress by the Borough of Rockaway or by any board, department or official appointed by or existing under its authority, or where the publication of such records by such department or official is expressly forbidden by statute, proclamation or regulation, or is otherwise exempt from the requirement that copies thereof be furnished upon request, or such publication would be inimical to public interest, the request for the same may be refused or denied. | | (6) | Copying by person requesting documents permitted. Where the document in question is more than 100 pages in length, the Clerk may permit the person requesting copies to use his own copying machine, provided that there is no risk of damage or mutilization of the documents and that it would not be incompatible with the transaction of public business. Such determination shall be completely within the discretion of the Clerk. | | | Q. | Application fee and escrow for requests for street vacations. Upon making a request to the Mayor and Council to vacate any portion of a public street, the applicant shall pay a fee to cover the cost of the administration thereof in the amount of $500. Additionally, the applicant shall post with the Borough Treasurer an escrow in the amount of $1,200 to be applied against the professional fees of the Borough professionals, including but not limited to the Borough Attorney, Borough Engineer and Borough Planner, as well as the costs associated with the recording of the formal ordinance vacating said public street. Any excess monies left over after all fees and costs have been paid shall be refunded to the applicant. In the event it shall appear that the escrow shall be insufficient to cover all such fees and costs, the Mayor and Council shall not finally enact the ordinance unless and until the applicant shall have paid an amount equivalent to the total amount of fees and costs charged to the Borough in connection with the street vacation.
